Installation of curb, gutter, sidewalk & pave out and various storm drain catch basin improvements. 

NO pre-bid meeting is scheduled for this project . 
Bids are required for the entire work described herein. 

The Contractor shall use only the forms provided in this specification package for submittal of the Proposal. 

The contractor, sub recipient or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract.  The contractor shall carry out applicable requirements of 49 CFR part 26 in the award and administration of DOT assisted contracts.  Failure by the contractor to carry out these requirements is a material breach of this contract, which may result in the termination of this contract or such other remedy as the recipient deems appropriate.  Each subcontract signed by the bidder must include this assurance. 

Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations.  These wages are set forth in the General Prevailing Wage Rates for this project, available at City and available from the California Department of Industrial Relations’ Internet web site at http://www.dir.ca.gov.  The Federal minimum wage rates for this project as predetermined by the United States Secretary of Labor are set forth in the books issued for bidding purposes entitled "Proposal and Contract," and in copies of this book that may be examined at the offices described above where project plans, special provisions, and proposal forms may be seen. 

Bidders shall use the higher wage rate listed in each above labor classification. 

The labor surcharge and equipment rental rates to be used under this Contract shall be as listed in the State of California, Department of Transportation Division of Construction publication entitled "Labor Surcharge and Equipment Rental Rates" that are in effect. 
 
The U.S. Department of Transportation (DOT) provides a toll-free “hotline” service to report bid rigging activities. Bid rigging activities can be reported Mondays through Fridays, between 8:00 a.m. and 5:00 p.m., eastern time, Telephone No. 1-800-424-9071.  Anyone with knowledge of possible bid , bidder collusion, or other fraudulent activities should use the “hotline” to report these activities.  The “hotline” is part of the DOT’s continuing effort to identify and investigate highway construction contract fraud and abuse and is operated under the direction of the DOT Inspector General.  All information will be treated confidentially and caller anonymity will be respected. 

This project has a goal of twenty-three (23) percent disadvantaged business enterprise (DBE) participation.  The City of Manteca hereby notifies all bidders that it will ensure that any contract entered into pursuant to this advertisement, DBE enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration of an award 

All bidders and Contractor's shall be licensed in accordance with the laws of this state, and with the provisions of Chapter 9 of Division 3 of the Business and Professions Code.  Any bidder or Contractor not so licensed is subject to the penalties imposed by such laws. 

This project is subject to the “Buy America” provisions of the Surface Transportation Assistance Act of 1982 as amended by the Surface Transportation Efficiency Act of 1991. 

At the time this Contract is awarded, the Contractor shall possess a Class "A” license for the work herein described. 

The Contractor may substitute securities in lieu of retention as provided in Public Contract Code Section 22330(a) or alternatively retentions may, at the Contractor’s request, be paid to an escrow agent as provided in Public Contract Code Section 22330(b).  If the Contractor substitutes securities or requests that retentions be paid to an escrow agent then all provisions of Public Contract Code Section 22330 shall apply to said retentions.  This provision shall not apply if prohibited by Federal Law. 

Plans and Specifications may be obtained at the Department of Public Works, 1001 West Center Street, Manteca, California, 95337, ((209) 456-8400].  Hard copies are available upon payment of $16.00 per set ($20.00 per set, if mailed), they are also available on a CD upon payment of $6.00 per CD ($7.50 if mailed). This fee is not refundable.  The CD specifications are in Adobe PDF format, plans are in TIFF format, they are for informational purposes only.  GENERAL CONTRACTORS MUST SUBMIT BIDS ON A HARD COPY OF THE BID DOCUMENTS OBTAINED FROM THE DEPARTMENT OF PUBLIC WORKS. 

Any bidder may withdraw his bid, either personally or by written request, at any time prior to scheduled time for opening bids.  No bidder may withdraw his bid for a period of 60 days after the date set for opening thereof, and all bids shall be subject to acceptance by the Owner during this period. 

Each bid shall be accompanied by a Certified Check, Cashier's Check or Bid Bond (using the Bid Bond Form found on page P-11) in the amount of ten percent (10%) of the total bid price, payable to the City of Manteca, as a guarantee that the bidder, if his/her bid is accepted, will promptly execute the Contract.  

The successful bidder will be required to furnish two acceptable Surety Bonds; one  for  Faithful  Performance  in an amount equal to one hundred percent (100%) of the total Contract price, and the other for Labor and Materials in an amount equal to one hundred percent (100%) of the total Contract price.  If a Corporate Surety is used then that Surety shall be admitted by the State of California. 

No bid will be considered unless it is made on a proposal form furnished by the City of Manteca, Department of Public Works and is made in accordance with the provisions in Section 2, "Proposal Requirements and Conditions," of the Standard Specifications and these special provisions. 

The City of Manteca reserves the right to waive minor irregularities or informalities in any bonds or Contract Proposal, and reserves the right to reject any or all bids received.
